How to write a job offer letter step by step
Make the verbal offer first
Call the candidate, share the key terms (title, pay, start date) and answer their questions. The letter then confirms what you discussed, with no surprises.
Fill in the essential terms
Include job title, manager, employment type (full-time, part-time or fixed-term), start date, pay and pay period, FLSA status (exempt or non-exempt) for US roles, location or remote policy, and benefits eligibility.
Add contingencies and at-will language
List background checks, I-9 work authorization or reference checks. In US at-will states, keep the at-will statement and avoid promising 'permanent' employment or guaranteed bonuses.
Set a response deadline and send
3–7 days is standard. Send it as a PDF or through an e-signature tool, and attach separate agreements (NDA, IP assignment, equity grant) instead of folding them into the letter.

Is an offer letter a legally binding contract?
In the US, an offer letter with at-will language usually isn't an employment contract, but promises in it (pay, bonuses, duration) can still create obligations. Outside the US, written terms often form part of the employment contract. Have offers reviewed by HR or counsel.
What should never be in an offer letter?
Avoid promises of job security ('permanent position'), guaranteed raises or bonuses you can't commit to, and anything that conflicts with your employee handbook. Keep equity details in the grant agreement, not the offer letter.
How long should a candidate have to accept?
